I feel kinda bad about having the shirt that has this print on it... The shirt was a gift and I was really happy I got it. But that was before I knew it was stolen art... If I knew it was stolen art, I would've just taken it back! But I'm glad I know the artist who drew this that's on my T-shirt. Sadly, I can't take the shirt back, but I will still appreciate the work that was done. :3 Great job, Rismo!

Too bad you supported art thiefs.
Rismo doesn't allow this artwork to be used commercially. When people sell it on a shirt then it is commercially and they make profit while the original artist doesn't.

Sorry then. I already bought the shirt though. What do you want me to do? Burn it? Sure as heck not going to. But I wasn't aware of this until I just read this anyways, so yeah...

There's a stupid rule when you sign up to DA that states:

"3.     License To Use Artist Materials. As and when Artist Materials are uploaded to the deviantART Site(s), Artist grants to deviantART a worldwide, royalty-free, non-exclusive license."

This means DA can take any art they want, and sell it without giving any money to the original artist. They get all the profit, and DA doesn't have to ask permission.

I absolutely HATE them for it. How could they just sell this beautiful and hard-worked-for piece?

:iconanimeblue92:
AnimeBlue92 Featured By Owner Edited Jul 16, 2014  Student General Artist
Did you actually read the article? The policy is saying you give them permission to use your artist for commercial purposes only for on DevinatArt Not on any third-party sites or sources.  "The point of question in our Submission Policy is one which gives us the right to present the artwork you submit to deviantART on deviantART. Thus, artwork posted to deviantART may be used in promotional material for deviantART (with all due credit for the work included), but never for non-deviantART commercial purposes, and never without express recognition of the original artist. "

Basically it's saying that if DA wants to use your work on for  promotions on their site, then they can be allowed to do so with your permission and  that they will give credit to you as the artist.

Also you should take a look at this response from the artist of this piece, JJ Harrison. jjharrison.tumblr.com/post/854…

In short, when he agreed to allow Cartoon Network to use this work for a comic book cover, he was also agreeing for them to use it anything else. That's completely fair use in my opinion. I'm actually wearing the shirt form now as I type this hahaha. It's such a cool shirt and beautiful artwork!

Sorry to bother you with this, but I just wanted to get an official word on this particular item before another possible Hot Topic argument was started elsewhere. I've seen this artwork for pre-order on a messenger bag here at Forbiddenplanet.com forbiddenplanet.com/118384-adv… and would just like to clear the air about whether this was done with your knowledge or not? Thank you.

I had a feeling this was the case when I noticed that you'd made an agreement with BOOM! Studios, which sells a lot of stuff at Hot Topic.

This crossover is legendary! Will probably be getting one of the shirts myself now that the issue's been cleared up.

Did Hot Topic ever contact you? They claimed this on their facebook: "We want to let you know that we have seen your post and take this very seriously . So here is the deal….. we don’t steal art, it just isn’t true. In fact for 25 years we have stood firm and insisted that all artists and bands get paid for their work. The merchandise we purchase is approved by who holds the rights to it, in this case it is Cartoon Network. All product is officially licensed and bought through the proper channels. In the rare case when something like this is brought to our attention we immediately contact all parties that it concerns to get to the bottom of the issue until it is resolved. We have reached out to Cartoon Network and also emailed the artist. We really love your passion for supporting artist, we do too!"

that's such bull, yes this particular design wasn't stolen.  but i've seen other artists find their work on their site and stores that they made and the work isn't licensed to any company. sadly some of those artists cant afford to sue.  one girl however did, and hot topic apparently had the products with her designs destroyed. same with a tattoo design someone made, she was furious that her work popped up in hot topic. it was her own personal tattoo design and hottopic stole that image. hottopic didnt pay her for the design either.

Um, Hot Topic actually legally bought the art... from DeviantArt.

From the submission policy:

6. Payment Unless otherwise agreed between Artist and deviantART in a writing from deviantART, the license granted to deviantART under this Agreement is royalty-free.

So basically, deviantart has the right to do anything they want with the art posted on their site. Sucks, I know. I just realized this too.
